Electronic tendering and bidding is an important part of China's economic transformation and upgrading, and an important application of the "Internet Plus" strategy in the field of bidding and procurement, it said on March 8. Recently, the National Development and Reform Commission issued a public announcement on the "Internet Plus" Bidding and Procurement Action Plan (2017-2019) (hereinafter referred to as the "Plan") for public comments. The draft of the plan defines the overall requirements, main tasks, organization and implementation of the "Internet Plus" bidding and procurement action (2017-2019).

As we all know, the most intuitive explanation of "Internet +" bidding and procurement is electronic bidding. Compared with traditional paper bidding, electronic bidding has unique advantages in improving the transparency of bidding and procurement, improving work efficiency, saving resources and transaction costs. Promoting electronic tendering and bidding is an important measure to implement the spirit of the 18th National Congress of the CPC. It is conducive to establishing an integrated sharing system of tendering and bidding information, transforming and improving the mode of administrative supervision over tendering and bidding, effectively giving full play to the role of social supervision and self-discipline, establishing and improving a credit system for tendering and bidding, standardizing the order of tendering and bidding, and preventing and punishing corrupt transactions.

With the official implementation of "Electronic Bidding Measures" and "Technical Specifications for Electronic Bidding System", local government trading centers and some large enterprises have begun to build or prepare to build electronic bidding trading platforms. Up to now, the coverage of the whole process of online electronic bidding transaction is still not high. Most of the trading platforms built by the government trading center claim to have electronic bidding and trading functions, but in fact, many of them lack functions and only realize part of the functions of electronic trading. In fact, few really use the whole process of online electronic bidding and bidding trading, and the operation services cannot meet the requirements of market players. However, the trading platform built by enterprises cannot be promoted rapidly due to the lack of functions or the requirements of entering transactions. How to promote electronic tendering and bidding, and how to act on "Internet +" tendering and procurement?

To promote electronic bidding requires active and effective guidance from top-level planning, technical standards, trading rules and other aspects of government departments. But the most fundamental thing is to give play to the role of market mechanisms, encourage third parties to build and operate trading platforms, accept trading platforms that meet testing and certification standards, reduce transaction costs, and improve service quality. The Plan (draft for comments) clearly points out that we should adhere to government guidance and market regulation, actively guide all kinds of market players to participate in the construction and operation of the electronic bidding and procurement platform, and give full play to the role of market mechanism. Accelerate the market-oriented development of trading platforms, encourage all types of market entities, especially private capital, to build and operate electronic bidding and bidding trading platforms in accordance with the market-oriented direction, so as to meet the bidding and procurement needs of different industries and professional fields.

As a matter of fact, the relevant departments of the state have put forward requirements for this point many times. Let's review the policies in recent years:

On July 3, 2013, six national ministries and commissions jointly issued the Guiding Opinions on the Implementation of the Measures (Development and Reform Regulations [2013] No. 1284), which clearly required speeding up the construction and application of trading platforms and guiding various subjects to construct and operate trading platforms in an orderly manner.

On August 25, 2014, six national ministries and commissions jointly issued the Notice on Further Standardizing the Construction and Operation of Electronic Bidding System (Development and Reform Regulations [2014] No. 1925) to encourage equal competition of trading platforms, pointing out that trading platforms invested and constructed by government departments are only used for projects invested by the government itself. Administrative supervision departments and public resources trading supervision institutions shall not uniformly stipulate or force the use of designated trading platforms for tenderers, nor shall they restrict or exclude the connection and exchange of information between trading platforms constructed and operated by market entities and public service and administrative supervision platforms.

On July 4, 2015, The State Council issued the Guiding Opinions on Actively promoting the "Internet Plus" action, which clearly proposed that "electronic tendering and bidding should be vigorously promoted in accordance with the market-oriented and professional direction".

On August 10, 2015, The General Office of the State Council issued the Plan on Integrating and Establishing a Unified and Standardized Public Resources Trading Platform (Guosaofa [2015] No. 63) to encourage market competition in the electronic trading system. Local governments should not restrict or exclude the connection between the electronic trading system built and operated by market entities in accordance with the law and the electronic trading public service system. The relevant electronic bidding and procurement trading system of enterprises under central administration shall be connected with the national electronic trading public service system and exchange information according to regulations, which shall be incorporated into the public resources trading platform system.

On June 2, 2016, six ministries and commissions of the State jointly issued the Notice on In-depth Implementation of the National Electronic Bidding Pilot in 2016 (Regulation [2016] No. 1392 of the Development and Reform Office), making it clear that one of the important tasks of the government pilot is to introduce a third-party trading platform to connect with the provincial public service platform and administrative supervision platform.

To promote electronic tendering and bidding, we must respect the law of the market, stimulate the vitality of the market, and better play the role of market players. This is because the trading platform built by market players can better meet the use needs of market players, and really play a role in improving the transparency of bidding and procurement, improving work efficiency, and saving resources and transaction costs.
